By accepting this Legal Notice, the User declares that they have read, understood and accepted the provisions herein, that they are of legal age (over 18 years old) and that, if using the Platform and the Website on behalf of a legal entity, they have sufficient authority to bind such entity.

2. PURPOSE

The purpose of the Website is to provide information about FARO, its products and services, as well as to provide the User with the tools and functionalities made available through it. FARO is engaged in the marketing of lighting and ventilation products.

3. ACCESS

Access to and browsing of the Website are free of charge, except for the cost of the connection through the telecommunications network provided by the access provider contracted by the User. Certain Website functionalities may require prior User registration through the creation of an account with access credentials.

4. RULES OF USE

The User undertakes to use the Website in accordance with current legislation, morality and public order, this Legal Notice and good practices. The User shall not use the Website to carry out unlawful activities or activities constituting a criminal offence that infringe the rights of third parties and/or violate any applicable legal provisions.

The User undertakes not to introduce or disseminate racist, xenophobic, pornographic or terrorist-apologist content or propaganda, or content that infringes human rights; not to introduce or disseminate data programs (viruses and harmful software) likely to cause damage to the computer systems of the access provider, its suppliers or third-party users; not to disseminate, transmit or make available to third parties any type of information, element or content that infringes fundamental rights and public freedoms recognised constitutionally and in international treaties; not to disseminate, transmit or make available to third parties any type of information, element or content constituting unlawful or unfair advertising; not to transmit unsolicited or unauthorised advertising, advertising material, “spam”, “chain letters”, “pyramid schemes” or any other form of solicitation; not to introduce or disseminate false, ambiguous or inaccurate information and content in such a way as to mislead recipients of the information; not to impersonate other Users by using their access credentials for the different Website services and/or contents; not to disseminate, transmit or make available to third parties any type of information, element or content involving a violation of intellectual and industrial property rights, patents, trademarks or copyrights belonging to the Website owners or third parties; and not to disseminate, transmit or make available to third parties any type of information, element or content involving a breach of communications secrecy and personal data legislation.

The User undertakes to hold FARO harmless against any possible claim, fine, penalty or sanction that FARO may be required to bear as a consequence of the User’s breach of any of the aforementioned rules of use, FARO additionally reserving the right to claim compensation for any corresponding damages and losses.

5. MODIFICATIONS

FARO reserves the right to make any modifications it deems appropriate to the Website, and may change, remove or add both the contents and services provided through it and the manner in which they are presented or located.

6. LIABILITY

FARO does not guarantee the absence of interruptions or errors in access to the Website or its contents, nor that they are updated, although it shall use its best efforts, where appropriate, to avoid, correct or update them. FARO shall not be liable for technical failures preventing or hindering access to the Website, temporary service interruptions due to maintenance, updates or improvements, or for any damage that access to the Website may cause to the User’s device.

FARO shall not be responsible for the truthfulness, accuracy or updating of the data entered by the User on the Website. The User is solely responsible for the information provided.

7. LINKED CONTENT AND SITES

The Website may contain technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, the “Linked Sites”). In such cases, FARO shall only be responsible for the content and services provided on the Linked Sites insofar as it has actual knowledge of their unlawfulness and has not disabled the link with due diligence. If the User considers that there is a Linked Site with unlawful or inappropriate content, they may notify FARO via [email protected]

Under no circumstances shall the existence of Linked Sites imply the formalisation of agreements between FARO and the parties responsible for or owners of such sites, nor the recommendation or promotion by FARO of the Linked Sites and/or their contents. Unless expressly stated otherwise, FARO does not know the contents and services of the Linked Sites and, therefore, shall not be liable for any damages that they may cause to the User or any third party.

8. INTELLECTUAL AND INDUSTRIAL PROPERTY

All Website contents, understood by way of example but not limitation as texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or audio contents, as well as their graphic design and source codes, are the intellectual property of FARO or third-party licensors, and none of the exploitation rights recognised by current intellectual property regulations over them shall be understood to have been transferred to the User.

The trademarks, trade names and other distinctive signs published on the Website are owned by FARO or third-party assignors and/or licensors, and no rights over them shall be understood to have been transferred to the User.

The reproduction, distribution, public communication, transformation or any other form of exploitation of the Website contents without the express written authorisation of FARO or the corresponding rights holder is prohibited.

9. SOCIAL MEDIA

FARO maintains profiles on the social media platforms Facebook, Instagram, LinkedIn, Pinterest and YouTube for the purpose of giving visibility to and disseminating its activities. These platforms store personal data on the servers of the respective services and are governed by their own privacy policies. Users are advised to review the terms of use and privacy settings of each social network when registering.

FARO reserves the right to remove from its social media profiles any information posted by third parties that violates the law, encourages such violations or contains messages that infringe the dignity of individuals or institutions, as well as the right to block or report the profile responsible for such messages.

10. MINORS

The Website services are not intended for children under 14 years of age. In accordance with Article 7 of Organic Law 3/2018 (LOPDGDD), LOREFAR, S.L. does not intentionally collect personal data from children under that age. If a parent or legal guardian becomes aware that a minor has provided personal data without the corresponding consent, they may notify [email protected] to request its deletion.

11. DATA PROTECTION

The processing of Users’ personal data is carried out in accordance with the Privacy Policy. FARO complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), and with Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights (LOPDGDD).
