These terms and conditions (hereinafter, “the General Conditions”) govern the access and the utilization that the user (hereinafter, “the User”) makes of the FARO BARCELONA Website (hereinafter, “the Website”). Through the acceptance of these General Conditions, the User states that: a. They have read, understood, and comprehended what is set out herein; b. They assume all the obligations set forth herein. The utilization of the Website attributes the condition of the User of the Website and implies the acceptance of all the terms included in these General Conditions. The User must carefully read these General Conditions each time they access the Website since the Website and these General Conditions can undergo amendments. We reserve the authority to make, at any time and with no need for prenotice, any amendment or update to the content and services of these General Conditions and, in general, of however many elements make up the design and configuration of the Website.

2. Access to the Website


Simple access to the Website is free of charge, except in relation to the cost of the connection through the telecommunications network supplied by the provider of access contracted by the User.


3. Utilisation rules of the Website


The User undertakes to utilize the Website and all its contents and services pursuant to the provisions of law, morality, public order, and these General Conditions. They also undertake to make proper use of the Website services and/or contents and to not employ them to carry out illegal activities or those that constitute a crime, that infringes upon the rights of third parties and/or that violate the regulation on intellectual and industrial property, or any other applicable legal rules. The User undertakes to not transfer, introduce, disseminate and make available to third parties any kind of material or information (data, content, messages, drawings, sound and image files, photographs, software, etc.) that are contrary to law, morality, public order, and these General Conditions. The Uses commits to the following, which includes but is not limited to: I.- Not introduce or disseminate content or propaganda that is racist, xenophobic, pornographic, or that glorifies terrorism or impinges upon human rights. II.- Not introduce or disseminate viruses and harmful software on the network likely to cause damage to the IT systems of the access provider, its suppliers, or third party users of the Internet network. III.- Not disseminate, transfer or make available to third parties any type of information, element, or content that infringes upon constitutionally recognized fundamental rights and public freedoms and international agreements. IV.- Not disseminate, transfer or make available to third parties any type of information, element, or content that constitutes illegal or unfair advertising. V.- Not transfer unsolicited or unauthorized advertising, advertising material, junk mail, chain letters, pyramid structures, or any other form of solicitation, except in those areas (such as commercial spaces) that have been exclusively conceived for this. VI.- Not introduce or disseminate any false information and content that is ambiguous or inaccurate in such a way that it leads the recipients of the information to make a mistake. VII.- Not disseminate, transfer or make available to third parties any type of information, element, or content that entails a violation of intellectual and industrial property rights, patents, trademarks, or copyright that correspond to the holder of the Website or to third parties. VIII.- Not disseminate, transfer or make available to third parties any type of information, element, or content that entails a violation of the secret of the communications and the legislation of personal data. The User undertakes to hold FARO BARCELONA harmless from any potential claim, fine, penalty or sanction it may be bound to bear as a result of the breach on the part of the User of any of the aforementioned utilization rules, FARO BARCELONA further reserving the right to request compensation for any pertinent damage and harm. FARO BARCELONA reserves the right to ban any User who infringes the rules and obligations established in these General Conditions and the utilization of the services offered through the Website.
 
4. Exclusion of Liability


FARO BARCELONA assumes no liability related to the updating of the Website, nor does it guarantee that the information published is precise or complete. Therefore, the User must confirm that the published information is precise and complete before taking a decision related to any service or content described on the Website. The User’s access to the Website does not imply for FARO BARCELONA the obligation to control the absence of viruses, worms, or any other damaged IT element. It falls to the User, in any case, to have appropriate tools for the detection and disinfection of damaged IT programs. FARO BARCELONA is not liable for the damage caused to the software and IT equipment of Users or of third parties during the use of the services offered on the Website, nor for any caused by failures or disconnections on telecommunications networks that cause the suspension, cancellation, or interruption of the service of the Website during the provision thereof or beforehand.


5. Content and services linked through the Website


The access service to the Website can include technical link devices, directories, and also search instruments that enable the User to access other websites and Internet portals (hereinafter, “Linked Sites”). In these cases, FARO BARCELONA will only be responsible for the content and services supplied on the Linked Websites to the extent that it has effective knowledge of the legality and has not disabled the link with due diligence. In the event that the User believes that there is a Linked Site with illegal or inappropriate content, it may inform FARO BARCELONA of this without this communication in any case entailing the obligation to remove the respective link. In no event must the existence of Linked Sites presuppose the formalization of agreements with the responsible parties or holders thereof, nor the recommendation, promotion, or identification of FARO BARCELONA with the statements, contents, or services provided. FARO BARCELONA is not familiar with the content and services of the Linked Sites and, therefore, is not liable for the damage caused by the illegality, quality, outdated nature, unavailability, error, and uselessness of the content and/or services of the Linked Sites, nor for any other damage that is not directly attributable to FARO BARCELONA.


6. Intellectual and industrial property


All the content of the Website, this being understood as including the texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as its graphic design and source codes, is the intellectual property of FARO BARCELONA or of third parties, without any of the exploitation rights recognized by the regulations in force with regard to intellectual property thereon being understood as assigned to the User. The brands, trademarks, or distinctive signs are owned by FARO BARCELONA or third parties, without it being understood that access to the Website attributes any right thereon.


7. Nullity and invalidity of the clauses


Should any clause included in these General Conditions be declared totally or partially null or invalid, such nullity or invalidity will only affect said provision or the part thereof that is null or invalid, replacing these General Conditions in all the rest, such provision is deemed totally or partially excluded.


8. Applicable legislation and competent jurisdiction
These General Conditions will govern and be interpreted under Spanish legislation. FARO BARCELONA and the User agree to submit any dispute that could arise between them to the Courts and Tribunals of Barcelona, Spain, under otherwise provided for by law.
