These terms and conditions (hereinafter referred to as the "General Conditions") govern the access and use that the user (hereinafter referred to as the "User") makes of the FARO BARCELONA website (hereinafter referred to as the "Website"). By accepting these General Conditions, the User declares: a. That they have read, understood, and comprehended what is stated herein. b. That they assume all the obligations set forth herein. The use of the Website attributes the status of User of the Website to the User and implies the acceptance of all the terms included in these General Conditions. The User must carefully read these General Conditions each time they access the Website, as the Website itself and these General Conditions may undergo modifications. We reserve the right to make, at any time and without prior notice, any modifications or updates to the contents and services; of these General Conditions and, in general, of all the elements that make up the design and configuration of the Website.

3. Rules for the Use of the Website

The User undertakes to use the Website and all its content and services in accordance with the law, morals, public order, and these General Conditions. Likewise, they undertake to make appropriate use of the services and/or content of the Website and not to use them for illegal activities or activities that constitute a crime, that infringe the rights of third parties, and/or that violate intellectual or industrial property regulations or any other applicable legal provisions. The User undertakes not to transmit, introduce, disseminate, or make available to third parties any kind of material and information (data, content, messages, designs, audio and video files, photographs, software, etc.) that is contrary to the law, morals, public order, and these General Conditions. By way of example, and not limited to or exclusive, the User agrees to: I.- Not introduce or disseminate content or propaganda of a racist, xenophobic, pornographic nature, or that promotes terrorism or violates human rights. II.- Not introduce or disseminate data programs (viruses and harmful software) that may cause damage to the computer systems of the access provider, its suppliers, or third-party users of the Internet network. III.- Not disseminate, transmit, or make available to third parties any type of information, element, or content that violates fundamental rights and public freedoms recognized constitutionally and in international treaties. IV.- Not disseminate, transmit, or make available to third parties any type of information, element, or content that constitutes illegal or unfair advertising. V.- Not transmit unsolicited or unauthorized advertising, advertising material, "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in areas (such as commercial spaces) specifically designed for this purpose. VI.- Not introduce or disseminate false, ambiguous, or inaccurate information and content in a way that misleads recipients of the information. VII.- Not disseminate, transmit, or make available to third parties any type of information, element, or content that constitutes a violation of intellectual and industrial property rights, patents, trademarks, or copyrights belonging to the owners of the Website or third parties. VIII.- Not disseminate, transmit, or make available to third parties any type of information, element, or content that constitutes a violation of the secrecy of communications and the legislation on personal data. The User undertakes to hold FARO BARCELONA harmless from any possible claim, fine, penalty, or sanction that may be required to be borne as a result of the User's breach of any of the above-mentioned usage rules, reserving the right of FARO BARCELONA to seek appropriate compensation for damages. FARO BARCELONA reserves the right to prohibit any User who violates the rules and obligations established in these General Conditions from using the services offered through the Website.

 

4. Exclusion of Liability

FARO BARCELONA assumes no responsibility related to the updating of the Website, nor does it guarantee that the information published is accurate or complete. Therefore, the User must verify that the published information is accurate and complete before making a decision related to any service or content described on the Website. The User's access to the Website does not imply any obligation on the part of FARO BARCELONA to monitor the absence of viruses, worms, or any other harmful computer elements. In any case, it is the User's responsibility to have adequate tools for detecting and disinfecting harmful computer programs. FARO BARCELONA is not responsible for damages caused to the software and computer equipment of Users or third parties during the use of the services offered on the Website, nor for damages resulting from failures or disconnections in telecommunications networks that result in the suspension, cancellation, or interruption of the Website's service during its provision or beforehand.

 

5. Contents and Services Linked through the Website

In these cases, FARO BARCELONA will only be responsible for the content and services provided on the Linked Sites to the extent that it has effective knowledge of their illegality and has not disabled the link with due diligence. In the event that the User believes that there is a Linked Site with illegal or inappropriate content, they may report it to FARO BARCELONA, without such communication in any case implying the obligation to remove the corresponding link. FARO BARCELONA is not aware of the contents and services of the Linked Sites and, therefore, is not responsible for damages caused by the illegality, quality, obsolescence, unavailability, error, and uselessness of the contents and/or services of the Linked Sites or for any other damage that is not directly attributable to FARO BARCELONA.

 

6. Intellectual and Industrial Property

All the contents of the Website, including, by way of example, texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound contents, as well as their graphic design and source codes, are the intellectual property of FARO BARCELONA or third parties, and none of the exploitation rights recognized by current regulations on intellectual property can be understood to be assigned to the User. The trademarks, trade names, or distinctive signs are the property of FARO BARCELONA or third parties, and access to the Website does not imply any rights over them for the User.

 

7. Nullity and Ineffectiveness of Clauses

If any clause included in these General Conditions is declared totally or partially null or ineffective, such nullity or ineffectiveness will only affect that provision or the part thereof that is null or ineffective, with these General Conditions remaining in force for all other purposes, considering such provision totally or partially not included.

 

8. Applicable Law and Competent Jurisdiction

These General Conditions will be governed and interpreted in accordance with Spanish law. FARO BARCELONA and the User agree to submit any dispute that may arise between them to the Courts and Tribunals of Barcelona, Spain, unless the law establishes otherwise.

In order for anyone, including employees, internal and external collaborators, and other stakeholders, to report in good faith any violations they detect in relation to FARO BARCELONA's activity, we provide the Company Informant Channel.
